These Terms and Conditions ("Terms") govern your use of the TJ Rose Landscapes website (tjrose.co.uk) and the provision of our garden design, landscaping, and build services ("Services") in Milton Keynes and surrounding areas.
By using our website or engaging our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or Services.

3. Services
3.1 Description of Services
We provide garden design, landscaping, and build services including but not limited to: garden design, patios and paving, decking and pergolas, outdoor kitchens, garden lighting, planting and turfing, and related garden improvement works.
3.2 Consultations
Initial consultations are offered to discuss your requirements and assess the scope of work. Details of consultation fees (if any) will be communicated prior to booking. By booking a consultation, you agree to provide accurate information about your property and requirements.
3.3 Quotations
All quotations provided are valid for 30 days from the date of issue unless otherwise stated. Quotations are based on the information available at the time and may be subject to change if site conditions differ from those initially assessed.
4. Agreements and Contracts
4.1 Acceptance
A binding agreement is formed when you accept our quotation in writing (including email) and any required deposit has been received. Until both conditions are met, no contract exists between us.
4.2 Scope of Work
The scope of work will be detailed in your quotation and/or design documentation. Any changes to the agreed scope must be confirmed in writing by both parties and may result in adjustments to the price and timeline.
4.3 Variations
If additional work is required beyond the original scope (e.g., unforeseen ground conditions, additional features requested), we will inform you of the additional costs and obtain your approval before proceeding.
5. Payment Terms
5.1 Deposits
A deposit may be required to secure your project start date. The deposit amount will be specified in your quotation.
5.2 Payment Schedule
For larger projects, payments may be structured in stages as outlined in your quotation. Stage payments are due upon completion of each agreed milestone.
5.3 Final Payment
The final balance is due upon completion of the project unless otherwise agreed in writing. Payment is accepted via bank transfer.
5.4 Late Payment
We reserve the right to charge interest on overdue invoices at a rate of 4% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
6. Project Timelines
We will provide an estimated start date and project duration at the time of quotation. While we endeavour to meet these timelines, they may be affected by:
- Adverse weather conditions
- Availability of materials
- Changes requested by the client
- Unforeseen site conditions
- Factors beyond our reasonable control
We will keep you informed of any significant changes to the project timeline.
7. Client Responsibilities
As our client, you agree to:
- Provide accurate information about your property, including any known underground services, boundaries, and planning restrictions
- Ensure reasonable access to the work area for our team and deliveries
- Obtain any necessary planning permissions or building regulations approvals (we can advise on this)
- Inform us of any relevant covenants, restrictions, or neighbour considerations
- Make timely decisions when required to avoid project delays
- Ensure the safety of children and pets around the work area
8. Guarantees and Warranties
8.1 Workmanship
We guarantee our workmanship for a period of 12 months from the date of project completion. This covers defects arising from faulty workmanship but does not cover normal wear and tear, damage caused by third parties, or issues arising from lack of maintenance.
8.2 Materials
Materials used in your project may carry their own manufacturer warranties. We will pass on any applicable manufacturer guarantees to you.
8.3 Plants
While we take great care in selecting and planting, we cannot guarantee the survival of plants beyond the initial establishment period. Plant health can be affected by aftercare, weather conditions, and soil conditions. We will provide aftercare advice for all planted areas.
9. Cancellation
9.1 Cancellation by You
If you wish to cancel after a contract has been formed:
- Cancellations made more than 14 days before the scheduled start date: the deposit may be refundable, minus any costs already incurred (e.g., design work, material orders)
- Cancellations made within 14 days of the start date: the deposit is non-refundable, and you may be liable for costs already incurred
- Cancellations after work has commenced: you are liable for all work completed and materials ordered
9.2 Cancellation by Us
We reserve the right to cancel or withdraw from a project if:
- Payment terms are not met
- Safe working conditions cannot be maintained
- Information provided by the client is found to be materially inaccurate
- Circumstances beyond our reasonable control make it impossible to continue
10. Liability
10.1 Our Liability
We carry public liability insurance for the duration of all projects. We accept responsibility for any damage to your property caused directly by our negligence during the course of work. Our total liability shall not exceed the total contract value.
10.2 Limitation
We shall not be liable for any indirect or consequential losses, loss of profit, or losses arising from circumstances beyond our reasonable control (force majeure).
11. Website Use
11.1 Intellectual Property
All content on this website, including text, images, designs, and graphics, is the property of TJ Rose Landscapes or used with permission. You may not reproduce, distribute, or use any content without our prior written consent.
11.2 Accuracy
While we strive to keep our website content accurate and up to date, we do not warrant that all information is complete, accurate, or current. Images on the website are for illustrative purposes and actual results may vary.
